Coming down to the Markman Ruling:...

1) I CAN GAURANTEE YOU THAT THERE SHALL BE A Markman Ruling by the Court...

2) I can gaurante you that Judge Kreiger shall follow the 9th Circuit Rulings that cover facts before the Court...

3) I can also gauranee you that RES JUDICATA shall apply on all FACTS upon which Judge Kreiger has to rule upon untill the Supreme Court has said otherwise.

Thus, there is no confusion relating the question if a FAVORABLE MARKMAN RULING can be relied upon in future cases brought by DM. As explained in the RP e-mail, and by jeffother, as to issues RULED upon Judge Kreiger, the ANSWER is YES. If there are some other issue , (like a different patent is used to sue uopn), then the ANSWER is NO...
