doni, I doubt it. I think we have to take the filing at face value and believe both parties wanted the extra two days. If EDIG did not need the additional time, but didn't object to the defendants request for additional time, then the defendants would have filed with a statement such as, "Plaintiff was contacted and does not oppose this motion".

Not sure why Imation did not engage in the meet and confer process...perhaps they are in settlement talks as you posted. Or perhaps any of a hundred other reasons.

One thing is for sure...the closer we approach a Markman, the more things are going to get very interesting.
