"IMO, Gil's use of the word "liabilty" is in the context of the judge ruling in favor of EDIG over the defendants, as in, "I agree you used their tech without consent/license/payment."

Gil needs to explain to you yet again what the Markman phase is all about....it's not about consent/license/payment , which at some point will be the liability issues.

The Markman issue deals specifically with matters of the patents, what they claim, how they were obtained, etc......there is no liability at this stage. The arguments are more... "this phrase is what this claim should state" and we want the court to agree with our consideration.

I did not want to comment on this.....but, I figure we're all learning here, so I hope you are not offended.....and I'm quite sure Minister has a handle on liability.

We're all caught up in this and sometimes we get ahead of our thoughts.
