It seems to me that being a commercial success in the design, manufacture and sales of new product has no bearing on who owns the patents.
Patent rights are just that....hence the term intellectual property. Why do then companies like INTEL hoard patents and build their patent warchests?
Of course EDIG could not compete with billion dollar companies, their marketing arms, branding and distribution channels, but regardless, the patents existed well before most of the products in question were yet imagined.
Most everything today is flash based. Not a bad space to own key patents.
The higher the costs of discovery, the higher the settlement. And if they don't want to deal, they can take their chances in front of a judge.
Think any will risk that? Not a chance.
