On 7/30/2010 the Court granted EDIG Motion to be releived of an earlier STAY Order regarding going forward with discovery.

That Motion was granted by the Court.

The effect of the Order granting the Motion to remove the STAY was STAYED for 21 days during which the parties were to let the Court know they had reached an agreement on how they "Might take an appeal from the construction determination", in which case the Court will reconsider its determination that discovery go forward.

Since there was nothing on PACER showing the parties had reached such an agreement as proposed by the Court, it is safe to say that "Discovery" is going forward, or the parties are working on some "Settlements"...
