Defendants are petitioning the Court to once again place a stay on discovery even though no agreement between the Parties was reached (Doc 306). They blame EDIG for trying to run up the costs of the Defendants which they say could be higher than the case is worth. They sound desperate to get discovery stayed and if the Court denies their request, we could easily see some settlements.
"Given the foregoing, e.Digital’s sweeping discovery requests are calculated solely to drastically increase the costs to Defendants of litigating this case. As this Court observed at the outset of this case, the costs of complying with these types of discovery requests may very well overshadow what this case is really worth."
