First of all, this is a vast generalization by the court, in its initial comments, who seeks the parties to settle, ultimately.

So, the question is, what is the cost of this sort of discovery.

I guess the defendants don't want to spend exhorbitant amounts of money in discovery and then still lose the case.

There is a simple solution to that problem....settle with DM and avoid the problem.
