I was wondering if Defendants' recent motion (Doc 309) to stay discovery again is merely a Hail Mary effort. The defending attorneys are required to make every attempt that would favor their clients, even if it has no real chance of succeeding. Gil has mentioned the Court will not rule in their favor on this motion simply because it is too expensive to the Defendants', but at least they'll be on record as having tried. The Court has already ruled discovery will continue and Gil said Courts don't like being asked to reverse earlier decisions.

I am certainly expecting a scathing DM response to Doc 309 soon.
