I would LOVE to see the 300 plus list of potentially infringing devices and rank them from 1 to 300 on level of importances/impact on the consumer electronics industry. I would think that there are a few categories of infringers products and their potential impact upon us:

1] minimal product sale/volume + minimal use of infringing technology [flash not used much and not that important to function as a device [e.g., phone with minimal mp3 use or application use, etc]

2] large product sale/volume + minimal use of infringing technology

3] small product sale/volume + large use of infringing technology

4] large product sale/volume + large use of infringing technology

I think you save the #4s for the last tier after the trap and bait have been set by previous settlements and a Markman. I think Apple falls into this category [large volume and large use of technology to write to flash potentially.....if they are infringing]
