Don't count on it...

RP may want to shout it from the roof top, but is DM that calls all the shots on legal matters...

If information that DM is dead set on getting his Markman Ruling is made public it will be counter productive to furher settlement negotitations. And what RP told KIRK indicates that DM is following a strategy of keeping the door open for "Settlement" negotiations while getting ready for January 28 2011.
