With DM doing their DD on HTC months I suppose before Nov 2, 2009 when we named them in the CO 19, would DM/EDIG/Pat N have known this 4G device was on the drawing boards? I think not, so during discovery or settlement talks, which ever comes 1st, I assume it can be added to the infringing products claim???
