Considering the fact how hard defense tried to defer discovery till after the Markman Hearing, it is strange ideed that PACER has been dead quite so far...

There is no mor than 2.5 months left to 1/28/2011. And it boggles the mind to think of the amount and complexity of the needed discovery that is to be finished before Markman Hearing...

That is why unless we get some MOTIONS TO COMPEL PRODUCTION of evidence filed by DM no later than next couple of weeks, I am convinced they are hard at work crafting settlement agreements with defendants as we speek...
