Gil if we do not get what we want before the Markman hearing and the judge goes ahead with our claim construction and we get a favorable decision can we say your honor based on lack of information from the defendents we believe our case is worth $$ from each defendent and if they do not believe us let the jury decide the amount that is fair in our case?
