If I follow what you and Tom are suggesting, I cannot see any advantage to edig on the summit settlement.
I don't understand why DM would negotiate a agreement which is in essence favorable to the defendant, unless the agreement contains two separate amounts, based on a lump sum payment, each amount based on the Markman ruling.
