From sman's DD, I see the USPTO could take up to 90 days to decide whether to re-exam or not. So doni, you may very well be correct that the USPTO is determining if there are substantial new questions of patentability with regard to the '774 patent. If not, the re-exam request will be terminated. I was under the impression from another poster's DD, that 90 days was the time to complete a re-exam.

I still don't understand why they'd assign the re-exam to Art Unit 3992 though, if the USPTO director is still deciding whether to even do the re-exam.
