JOE , After reviewing of several similar cases i noticed usually the judge has

questionable and unfavorable view toward thost late filers .

As we notice just 2 months prior to Markman Hearing defendants tried to file

for patent reexamination . customary majority of those will be granted. This is

one of those last tactics and favorite one specially in complex multidefendant cases.

Their immediate intention is TO OBTAIN STAY BY JUDGE PENDING REEXAM DECISION.

As far as we know so far judge Krieger did not granted such a stay and this is by itself

is a victory for e.DIGITAL legal team. I believe this reexam request by defendants is

another ploy to establish SNQ and as article said dampen settlement expectation and

those are very limited goals . This is just my personal opinion and welcome to hear

other legal expert in this subjects.
