IMO, the same might happen with the Markman...is it necessary for the court to reveal procedural issues of the court that relate more to the formal trial, where if revealed might allow a jury to prejudge?

IMO, if there are settlements following the courts considerations of the Markman hearing, you will then know how the Markman paned out.

Myself, as an investor of the IP, I would not want to show my hand in the event that there will be future litigation.
