Technically, settlements and round 3 filed before a ruling does not either, but a safe bet as an indicator how it may/will pan out.

To be more clear on my comment, the tone of the hearing, the body language and jib jab observed by SS may give a strong hint which way it may go.

Nothing is a sure thing until the judge rules, but all the above and then some may tell the story.
