Let my preface my post by saying that I, along with all the other shareholders, wish that the district judge rules in favor of Edig. Now inspite the arguments DM advanced and the excellent analysis of John, there is still a prima facie argument in favor of the Magistrate's decision. This is that the plaintiff's attorneys always ask much more questions than they have to or are necessary for the task at hand so that they make the life of the the defence far more difficult than it should be. In addition, they post far more time than it is necessary and increase the cost accordingly. Judges know that much and some of them are more sensitive than others. This is clearly the case with our Magistrate. Now none of us knows how these two issues are weighted in the mind of the District judge. I wish her judgement favors Edig; but I wouldn't be surprised if it will not.
