I really appreciate the tremendous effort and personal time both of you spent in providing the edig group with your documentation of the Markman proceedings.

It was an advantage to have two individuals present so that a sounding board on key issues could be used for clarification on these complicated topics.

I’m aware of the difficulty in reporting on an event when you are personally involved, but sense in reading the transcript, that you gave total effort to eliminate any bias.

I have read your notes twice, some specific text more than twice and conclude that although insightful, that trying to draw a positive conclusion from the data is balanced fairly even.

I see that the objections, overruling and sustaining of various points were basically very fine points of law and would have been made by any high standing law firm.

It does appear from your notes that DM was the best prepared and presented meaningful information relative to the specific issue. Less prepared were the defendants, particularly concerning some of the detailed patent aspects. Of course this may not have any bearing on the legal issue, which will be studied by the judge and her support group.

As to why DM did or did not submit specific reports and or want the remaining 6 claims construction areas to be part of the summary judgment, I have to believe they didn’t make any mistakes or miscues.

I think the story tells us that most if not all of the remaining defendants will continue on without any settlement and wait for the Markman ruling.

I don’t see your report telling us that we have a one sided favorable ruling coming soon. I think it’s an even bet looking at the legal issues and believe it will take as many as 60 days, however I hope it will be sooner.

Again, thank you two for a great job enabling us to look into the depth of issue at hand which may ultimately decide if we will achieve the rewards we have been waiting for ten years.

As to any immediate spike in the share price, pretty much an emotional event that will settle back quickly, depending on if we see any settlements and what the eventual ruling will be.

I’m sure there are many other opinions from board members regarding who won after reading the script and the price impact next week.

Just an opinion of a long term shareholder.
