That question got anwsered by the Judge, in one of those 4 interstitial conversations with edig attorneys, through her soliloquy saying;

"OK, if these two claims are ruled as dispositive to the case, I won't rule on the other claims" (See, middle of 3rd paragraph from bottom of page 10 of SS Report.)...

I bet at that moment the EDIG TEAM were ready to jump out of their skin, and have been emptying cases of Dom Perignon 2002 Champagne this week end.

The fact that defense wanted to have the other 6 claims ruled on is not germane. If the Judge follows the road map suggested by EDIG team as being the applicable case law, then she CAN do what she SAID she is going to do...
