There was no mention of Judge Wanabe being present. Not sure you'd be able to recognize if he was among those present but it almost seems self evident that his presence is required. The reason I ask is that on your first page you mention Judge Kreger being confused about intrinsic vs extrinsic evidence. Judge Wanabe was involved in most if not all phases leading up to the Markman. I would think a more fair and balanced ruling on the markman would result from having Wanabe involved. Any thoughts?

I'd welcome anyone elses insight into the process. Could be this is standard Operating proceedure.
