Considering recent reports of settlement with some of these same IP infringers in the neighborhood of $40-$80 million, not to mention ongoing royalty agreements, the plaintiff's attorneys certainly started at figures much higher than the settlement numbers...probably $100 to $200 million or more.

That also means the defense was authorized to go "as high as" these final agreements, if not higher.

Considering the ramifications of a simple patent for record and playback on flash, something integral with virtually every cell phone, video recorder, etc, overlayed over 13 years of "free" infringement and hundreds of billions of dollars of sales, DM better be bold.

In the first round they had other issues, like EDIG's viability as a ongoing entity, to deal with, but now they have already gone Markman, not interested or settling for any preMarkman deals.

By their own admittance, the bar has been raised. Now will these billion dollar companies put this in the hands of a jury that blames rich, corporate America for everything, a situation that they cannot control, or will they settle for what seems like a lot of money but, which, in reality, is a pittance to their overall corporate structure and is seen as the cost of doing business in today's world?

We know what they have just done recently.

Advantage EDIG, imo, and I am hopeful DM is right there, on point.
