More thoughts. If EDIG wins even 1 of the 2 key claims, I would hope the judge would rule on the remaining 6 claims. And if she did, I doubt she'd grant a motion for dismissal by the defense. This would be a good result for EDIG.
Same thing if she were to choose her own claim construction of the 2 key claims. I think the case would continue and hopefully the defense would be more inclined to settle before trial. This would also be a good result for EDIG.
The only bad result for EDIG is if the judge rules against us on both key claims.
