Considering this was announced today, the talks have been ongoing, in the face of the Markman. Apparently the numbers DM is requesting are now beginning to look more reasonable.

I hope to see at least half of the cases go this way, beefing up EDIG's finances and 10K, while keeping the key infringers on the line for the judge's ruling and hopefully even larger settlement numbers. She should be nearing a decision with the point of this to encourage settlement.

Featherstone represents the majority of this round, not sure exactly how many, but it is now apparently show time, now that a Markman decision is imminent.
