This was a legal maneuver by DM to gain advantage, the "judge" ruled against their appeal of the magistrates decision regarding who will pay for "outside vendor" expenses to produce information requested under discovery.

While it would have been nice to succeed, it's not the end of the world and the sky is not falling due to this ruling. Like you said, looking forward to the ruling on the Markman Hearing.
