Well, that ain't exactly right. The patents/tech were being infringed over a decade ago. I recall a conversation with RP in Jan 2000 (when trying to get the second MP3 to SDMI article published) where I specifically asked about patent enforcement because it appeared infringement was occurring. I asked because I saw the value of the patents.

The answer was that EDIG wanted to wait until Flash became "ubiquitous" with wider spread infringement. At the time I could see the logic, to a degree, though IMO the better strategy would be to go after 'em ASAP, and nail the rest as they entered the market (capturing the momentum of somewhat frenzied market entry).

You cannot tell me that EDIG did not have available resources in early 2000. And RP's reason for delaying action had nothing to do with lacking resources.

This is not meant as a bash, only a correction to a retelling of history.
