The actual Notice, per my understanding, MUST include certain legal language and be verifiable as to delivery of Notice.

Passive knowledge by a company of their infringement does not qualify as legal notice, regardless of source. They must be presented formal, verifiable Notice with proper language. This is my understanding - and I'm not a patent attorney.
