This is a total guess, and ONLY MY OPINION of something that should be reviewed by the engineers on the board... I am NOT an engineer, and NOT even close! and these things may not be related at all.

1 e.Digital and Samsung began the "settlement" in August 09...took until 10/09 to finalize...

.".1. e.Digital and Samsung have executed a Settlement Agreement. Pursuant to that

agreement, Samsung agreed to comply with certain obligations by October 19, 2009.

Following Samsung’s compliance with those obligations, e.Digital and Samsung

expect to file a joint dismissal with prejudice of their claims and counter-claims against each

other by October 26, 2009." (per 9/09 motion to stay)

2. If you google the title to e.Digital's pending encryption patent:

System and method for securely transmitting data to a multimedia device

3. .interestingly enough the second finding, is a patent filing by samsung by almost the exact same title:
is as follows:
(METHOD AND SYSTEM FOR SECURELY TRANSMITTING AND RECEIVING MULTIMEDIA CONTENT
United States Patent Application 20100128780
4. while this is not a similar patent (to a non engineer), if you look at the pdf diagram attached to this patent app that was
filed by samsung, (on 11/20/2009, 30 days from the announced cross licensing.)... you will see that in the diagram, 115 is the
"content media box...and there are certain "elements" that allow samsung to identify users, content etc.
" the content server 115 includes one or more elements for ascertaining the identity of the visitors"........to a layman the
description looks like it might include our encryption patent pending technology, but frankly I might have too much
ttime on my hands------but possibly, It might support our "claims to digital rights management", etc with the innovations group.
5. IN MY OPINION, and only a guess, I also
believe that the "enforcement activity" that was /is to precede markman, is not necessarily new litigation, which I originally thought, but
I now think that the enforcement activity is new products/business developments that have been ongoing but not announced, and possibly related
tto cross lic agreements from over a year ago....(olympus also had cross licensing).
ttake a look and give your opinion/
