The other complicating factor that might be difficult to gage is the agreement between Duane Morris and E-Digital in case of a buyout. Just as an example if Apple decided they wanted to buyout E-Digital to avoid dealing with an infringement suit, it seems that Duane Morris would have missed out on a potentially large settlement. Im not sure if they put anything into the agreement when they first started this process, but it seems it is in the best interest of Duane Morris to not let something like this happen. Could Duane Morris prevent the patents to be included in a buyout?
