Obviously the judge and the court clerks could not trade on knowledge of the Markman Hearing results, or even the technician entering the data onto the Pacer system. But since Pacer is a member only system, and not public, would it be illegal for someone to trade on Pacer data before it becomes public? Once it is posted on a public forum such as Agoracom, trading on the knowledge should be legitimate. The best scenario is for E-Digital to be able to make a public announcement prior to the decision showing up on Pacer.
