I was thinking the same thing as I was catching up on the messages this morning.

No sense in publishing a finding / ruling if it is about to be superceded (and likely overruled / overturned) by a ruling by the SCOTUS.

I wonder if the recent defendant to settle saw the writing on the wall with the Word case.
