Of course, both sides could have decided no settlement was warranted and gone their separate ways. I think that is unlikely though, especially given the following excerpt from Doc 330 in Dec 10:

"Plaintiff e.Digital and Defendant Summit have been engaged in confidential settlement negotiations which both parties anticipate are likely to lead to resolution of the lawsuit as to Summit." (emphasis added)
