Both sides are operating in the dark. DM has to consider each infringer's exposure and decide what the risks are. They also need to be ready to launch round 3 in the event the Markman goes EDIG's way.

It is encouraging to see them scoring more settlements before the end of this quarter rather than delaying into Q2.
