I am not a lawyer either, but i read into this as the courts intrepretation of the construction arguements by DM to be different than those that were argued and that both parties must now submit briefs as to what or where they want to take this. Either way, there won't be an answer for another 30 days minimum. JMHO, others jump in on this please.
