Those are major issues in the non-decision...

In fact the Judge herself gave the parties 30 day extra time soliciting their input as to how they should approach this...

She knows that she cannot get away by not ruling on the 6 untried claims via her observation that the parties agreed a ruling on the 2 tried claims would be dispositive of the rest of the claims.

Simply said, any decision by her has to be factually supported. If the claims were not tried there were no facts in the record. And her version of what the parties agreed to does not agree with the record that each partiy made a point that she should rule on the remaining claims...

Now, if parties file briefs requesting further hearing on all the claims, something I doubt, she may jump on it and grant extra hearing time, thus by passing the 6 month time deadline for a decision.

I am at lunch break in Las Vegas attending a convention. I will be back next Wednsday. I think we shall hear from DM by then...
