I've reviewed the claim term at issue and studied it very closely....I know what e.Digital wants and I know what the defendants want....technically.

There is a balance in there that allows the court to be non-bias....and not have to pick sides.

She is not seeing it or she is bias....It is very clear to me what she could have done to be fair.

It's a matter of what type data is being stored, digital, or analog...In the consideration she has given, she is not saying analog or digital storage and leaving that to your imagination as to what data type...however she is forcing the issue of "NO RAM" which implies Analog storage.

If she had it in her mind to be fair(as she noted) at the outset, ...all she has to do is drop the " digital data" which infers the need for RAM, and drop the "NO RAM" issue which infers no need for RAM. and fashion her response around that.

Leave it to the trial....

She's taking sides for sure.
