What it boils down to for any business (and DM & Co. is a business) is "money". What they decide to do will based on what is the best business for them.
They have a lot of time and money invested at this point. How they feel about the case overall and whether they fight onward or decide to cut their losses will be determined once again on what's best for their business . Truth is we just don't know yet.
As another poster mentioned, we were at a higher PPS "prior to DM coming on board" and we had a boat load of debt. Right now we have no debt, some money in the bank, "some" income from EVU purchasing and service contracts, (additionally we don't have anywhere near the expenses we once did) a security patent still hanging in limbo and upward of 11 new patents. Who knows what good things the future may bring?
None of these things alone would be as good as DM girding their armor convinced they could win the battle, but all are better than where we were before...in other words we're not dead. The very worst thing would be for the company to cease to exist. "Anything" is better than dead (figuratively speaking for those I know will chime in without this disclaimer :)
My hope is that DM feels convinced that the judge got it completely wrong and decides it's worth the fight. Meanwhile even with the disappointment we all feel, hang in there if you can and keep the faith.
