If in fact the court made a judgement that was non-detrimental to EDIG, why then would she offer the comment something to the effect of, "but I can see how it may be viewed that way?" I believe your technical expertise, of which I have none. I am simply trying to read English and make logical sense of what we are dealing with. Why would she editorialize her ruling?
