After putting the pieces together....the comment in foot not 4 was a comment the court made and considered....however....if you read my prior post, I see what the court did in consideration of that comment .

Basically considering "I'm not getting involved in that possibility." and more than likely considering the patent is published digital by the details of CODEC as the only descriptive in the patent.
