I'm hoping the defense realizes EDIG has a serious chance at winning an appeal on Judge Krieger's claim construction and that both parties are neck deep in settlement talks. We'll know by next Thursday at the latest.

My question is... if substantial settlements occur on the contingency that EDIG does not appeal the CC ruling, how does this affect EDIG with future lawsuits against new defendants? The ruling on flash memory is in the legal books unless appealed. My guess is that this issue is huge in on-going negotiations. If I'm right, DM/EDIG are weighing their chances at getting the CC reversed on appeal versus accepting the settlement numbers being offered by the defendants.
