I would like to add one thing re: 75/25

My understanding is DM has a committee at the corporate level, that review all aspects and vote whether to take the case on a contingency basis and what terms and conditions they draw up in the contract offer. A 75% chance of success is the minimum criteria.

Of 26 filed upon to date, 13 have settled/licensed...batting 1000. Now this Markman deal certainly has a snag, and as you said they have a back up plan, thus it's still active. They are still at bat.
