Here is how I see it:...
Youngwirth could not specify a date for an ORDER by the Court. However, if you read # 398, it is quite clear that is exactly what youngwirth is after, the 30 days that is...
On Page 3, lines 3-5 of pasrt 2, OF #395 here is what Youngwirth says:
"Accordingly, e.Digital proposes that the nest step in this case is for the Court to enter an Order construing the term "flash memory" of claim 5 of the 737 patent"...
Then he (Youngwirth that is), ties up the second joint statement to be filed by the parties to 30 days after the issuing of the above order by the Court,( See, part 4, on page 4, the last 4 lines.)
Lastly, the paries have submitted a NEW plan for futher discovery to last 90 days from the Joint statement of 7/28/01. The Judge has to issue an ORDER affirming that plan.
That is the reason I think we will hear from MK tomorrow...
