I'm not a lawyer but I think we're forced to wait for the conclusion of the reexam to file round 3. If we file against another round before the reexam all that has to happen is one of the infringers has to ask the judge for a stay to wait out the reexam and it would likely be granted. I don't think DM is willing to take that risk at this time. I'm sure they will prepare for it but I doubt it they will actually file against the next round.
