Message: Re: issues to consider - re-exam results

the first thing to do is link the references and then review them 1 by 1:

1.....Kimura et al., entitle, "Development of an IC-Card Sound Recorder," Sharp Technical Journal, Vol. 55, March 1993 - Certified English translation, hereinafter "Kimura et al";

2....EP Pat. Application Publ. No. 0536792 A2 to Sharp Kabushiki Kaisha, published 04/14/1993, hereinafter "Sharp";

3....U.S. Pat. No. 5,442,768 to Sudoh et al., filed 11/05/1992, hereinafter "Sudoh et al";

4....U.S. Pat No. 5,267,218 to Elbert, issued 11/30/1993, hereinafter "Elbert".. As noted in the Reexamination Order filed on 01/11/2011, all the above-cited references qualify as prior art to the `774 patent.

Then determine which issues are field of use analog only and field of use digital only....along with, what types of memory are involved and the ability of that memory.....be it analog memory, or digital memory.....they are specific.

For e.Digitals patent 774....claim 19 "recording medium" represents analog memory, and for claim 1 & 19 "flash memory" represents digital memory. One needs to get it clear in their mind exactly what claim 1 is and what claim 19 is of the 774 patent.....and how the word "sole" ties "flash memory" for use under claim 19 and claim 1.

While keeping in mind, that e.Digital manages both field of use issues on a sole "flash memory"(digital memory)....and manages it with 737.

IMVHO, you are not going to find any of the above references having that ability.

I'm not able to locate item 1
