there was always a problem with the patents as acknowledged by DM to a member of this board at the Markman Hearing. The judge ruled on the patent and narrowed the scope from what DM was pushing. She did not invalidate the patent but made it less valuable. I am quite sure DM is attempting to get as much money as possible without having to go to court and have a jury confused. I do believe that someone who attended the shareholder's meeting stated that DM would wait for the reexam before filing further cases.
