Will the shareholders get screwed? If it is between Fred and the board getting screwed and the shareholders--you know the answer.
Following the Markman hearing the stock price reacted very negatively-duh. IMO those investors were betting on a pop following the anticipated positive hearing result which obviously did not materialize. They were not in for the long haul like many of us here are/have been. Yet there are no summary judgements being requested and we have continued to achieve settlements and some income--albiet smaller than we believe we deserve. The ruling has cost us some time and some money, but really changed nothing.
Positive reexam is a must--meeting with patent office recently rescheduled for late Nov.(2011 that is) so those results may come sometime early to mid 2012--on the Edig time scale not the distant future.
IMO we would have to achieve several milestone positives which would raise the sp and attention to the company to think that a buyout is a possibility. Companies are bought and sold on definitive cash flow projections--until we get there we have nothing to discuss.
