IMO, for those that settled with a license, there may have been negotiated considerations surrounding e.Digitals proposed construction....allowing for full license issues "with prejudice".
For those that did not license, they may have not considered e.Digitals proposed construction in settling, resolving a lesser issue...."with prejudice"....however, without license.
In which case e.Digital can revisit the issues regarding its proposed construction.....if the re-exam is positive and tweaked to more align with construction considerations.
DM, IMO, is waiting on a tweak...of the re-exam.....lol.
If one feels up to that task, review defendants and plaintiffs proposed construction issues, re-read the 303 material and you may see the pieces as I do.
