Correct. What sman has been posting is part of the prosecution history from when the patent was in process of being issued originally... and I believe was provided to the PTO (along with other court documents from the MH) as background information for the re-exam. People here seem to be reading this information as if for the first time and don't seem able to keep the facts straight or read it in the proper context.
