That consideration would be a future event for e.Digital if they get what they want from the re-exam.
e.Digitals conumdrum, however, is about overcoming the prior art issue.....having broad patents in front of e.Digital.
That said, the prior art broad patents challenged against e.Digital patents are not in contention of re-exam and they did not initiate the re-exam of e.Digitals patents.
If they were in contention to modify....they would have to be published patents, where articles in magazines mean nothing having no real authority.
Conditions noted of the article you posted would also have to apply.
